ADVENTURE MINDS DISCLAIMER AND RELEASE WAIVER
Introduction
You are expressly advised and you acknowledge that the services and activities offered by ADVENTURE MINDS PTY LTD carry risks, including the risk of personal injury. You agree to participate at your own risk.
In this Agreement, "our Services" includes but is not limited to the workshops, seminars, adventure activities, outdoor exploration, and any other activities as detailed in our program descriptions. "Injury" means all forms of physical, mental, and emotional injury related to these services, including but not limited to breaks, strains, lacerations, dislocations, dehydration, trauma, anxiety, and death.
Our Services are designed for use by persons aged 5 to 17 years, as well as adults. We provide our Services to minors where a parent or legal guardian agrees to these terms and conditions on behalf of the Minor. If we are not satisfied that a parent or legal guardian has agreed to these terms on behalf of a Minor, we may choose not to commence providing our Services or may suspend and/or cease providing our Services.
IN CONSIDERATION OF US ALLOWING YOU TO PARTICIPATE IN THE SERVICES, YOU ACKNOWLEDGE, UNDERSTAND, AND ARE AWARE THAT:
You have voluntarily chosen to participate in the services provided by us. You understand the inherent risks in these activities and willingly assume full responsibility for any risks and accept full responsibility for any injury that may result from participation.
Participation is entirely voluntary. You are not obligated to participate in any service you do not wish to do and may refuse participation or end participation at any time. You agree to notify us of any pre-existing medical conditions prior to the start of services.
You agree to waive any and all claims against ADVENTURE MINDS PTY LTD, its directors, officers, employees, agents, volunteers, and contractors for any loss, damage, injury, or expense you may suffer as a result of participation in our services due to any cause, including negligence.
This Agreement shall be binding upon you, your successors, representatives, executors, assigns, or transferees. If any portion of this Agreement is held invalid, the remainder shall remain in full legal force and effect.
You give us permission and authority to arrange for emergency medical services for you should you become injured, understanding you are responsible for any expenses incurred.
Emergency Procedures and Safety Measures
We have established emergency procedures and safety measures for all activities. These include:
Ensuring safe and appropriate conduct of activities in line with best practice standards.
Having a plan for managing emergencies, including access to first aid and contacting emergency services if required.
Regularly reviewing and updating our safety and emergency procedures.
Parental/Guardian Responsibilities
For participants who are minors, parents or guardians are responsible for:
Communicating with the facilitator about their whereabouts before and after sessions if they are late.
Ensuring their child is prepared for activities, including bringing necessary items as listed in the program descriptions.
Data protection and Privacy
Participant data will be collected, stored, and used in accordance with our Privacy Policy, which is available upon request. This policy outlines how we protect your personal information and respect your privacy.
Acknowledgment
By agreeing to this waiver, you acknowledge that you have read, understood, and agree to the terms and conditions outlined above.
